JIM HUBBARD is a veteran trial lawyer with over forty years of experience successfully representing clients in high stakes employment, tort, and commercial litigation cases in state and federal courts throughout the United States. His experience extends to a wide range of legal issues, including wrongful termination, breach of contract, unfair and deceptive trade practices, gender and age discrimination, breach of fiduciary duty, and fraud. He is admitted to practice in New York, Florida, North Carolina, and the District of Columbia, and federal district and appeal courts throughout the United States. He is an active member of the Federal Bar Council, whose membership consists of lawyers and judges who practice primarily in federal courts within the Second Circuit, and of the Association of the Bar of the City of New York.

Mr. Hubbard received his law degree from Georgetown University Law Center, in Washington, D.C., where he was an Editor of the Georgetown Law Journal. He served as an Assistant United States Attorney for the Eastern District of Virginia, and as law clerk to Judge David W. Dyer of United States Court of Appeals for the Fifth Circuit. He is a Fellow of the American College of Trial Lawyers, and serves on its Committee for the Teaching of Trial and Appellate Advocacy.

He has frequently served as lead counsel for groups of employees, stockholders, and insurance agents and brokers in consolidated suits or class actions involving claims of wrongful termination following merger-related reductions in force, the loss of employment benefits in merger-related transactions, IPO or merger fraud, and breach of commission and compensation agreements. In addition to his trial and appellate experience in state and federal court, Mr. Hubbard regularly represents clients in arbitration matters before FINRA, the AAA, and other leading arbitration forums involving securities and employment law disputes.

Many of his cases have achieved ground-breaking results. As lead trial counsel, Mr. Hubbard won a $29,273,190 jury verdict in the Southern District of New York, including $20,000,000 in punitive damages, for a former UBS institutional equities saleswoman who asserted claims of gender discrimination and retaliation. It is the largest verdict ever obtained in the United States for an individual plaintiff in an employment discrimination case. The case, Zubulake v. UBS, also resulted in leading decisions by United States District Judge Shira Scheindlin on a wide range of electronic discovery issues, including a litigant’s duty to preserve electronic evidence.

In other notable cases, Mr. Hubbard obtained the largest defamation verdict in Arizona history for a former Citigroup broker who was slandered on the Internet by a lawyer advertising for clients. Together with partner Robert Beckham, Mr. Hubbard won a landmark decision from the Florida Supreme Court, after ten years of litigation, that preserved Florida’s ownership of sovereignty submerged lands – lands beneath navigable rivers, lakes – from the claims of major phosphate companies to private ownership of Florida’s historic rivers and lakes, and the mineral deposits beneath them. As co-lead counsel, he obtained certification from the Massachusetts Superior Court of a nationwide class of thousands of disability insurance brokers, and a multi-million dollar damages recovery for members of the class, whose contracts had been breached.
